Terms & Conditions

Unless otherwise expressly agreed in writing, all goods are sold upon the following terms and conditions to the exclusion of any terms and conditions of the Purchaser and no agent or representative of PressCo Printing (the Company) has any authority to vary or omit part of or all of, these conditions.
Placement of an order with PressCo Printing shall constitute acceptance of these terms.

Quotations

Estimates or Quotations are based on the accuracy and PressCo's interpretations of the specifications submitted and are subject to review upon PressCo's receipt of the Purchaser's artwork, digital file or other materials.

Estimates or Quotations not accepted within 30 days are subject to revision.

Pricing

Our Web Site pricing is subject to change at any time however once an order has been submitted we will hold the pricing (higher or lower) in effect at the time of order submission.

Reproduction

Purchaser warrants and represents to PressCo that he is lawfully entitled to reproduce and copy the pictures, text and any trademarks used in the material ordered and has full authority to authorize PressCo to reproduce and copy such pictures and material.

The Purchaser shall indemnify and hold harmless PressCo from any and all loss, cost, expense and damages of any and all manner of claims, demands, actions, and proceedings that may be instituted against PressCo on grounds alleging that said printing violates any copyright or any proprietary right of any person, or that contains any matter that is libelous or scandalous, or invades any person's right to privacy or other personal or economic rights. The Purchaser agrees to protect and defend and promptly defend and continue the defense, at Purchaser's own expense, PressCo from economic loss or any other harmful consequences that could arise from the work. This means that the Purchaser will hold PressCo harmless and save, indemnify, and otherwise defend PressCo against claims, demands, actions, and proceedings on any and all grounds that may be brought against PressCo provided that PressCo promptly notifies the Purchaser of legal action and gives Purchaser reasonable time to undertake and conduct a defense. This will apply regardless of responsibility of negligence.

PressCo reserves the right to use reproductions for purposes of display and other advertising purposes.

Alterations

Alterations/Corrections/Changes - work performed in addition to the original specifications will be charged at PressCo's current rates.

Cancellations:

Orders cannot be canceled after you approve or waive your proof. Orders canceled prior to proof approval are subject to the following charges: If canceled prior to to preflighting your files a $15.00 processing fee will be charged. If canceled after preflighting files a $50 fee plus any time charges at our current rates for any file work that was performed on your files. Mailing Services jobs where your mail list has been processed prior to cancellation will incur a $50 processing fee in addition to the charges above.

Returns/Refunds:

All products are custom made to your specifications and all sales are final. Claims for defects, damages or shortages must be made within 24 hours after your package arrives. Failure to make such claim within the stated period shall constitute irrevocable acceptance and admission that the products fully comply with the terms, conditions and specifications.
Orders may not be returned without prior written authorization from PressCo. Orders returned must be done so at the client's expense. No credit or replacement will be issued without prompt return of the entire order. Every single sheet, or item, that was sent to you must be returned unused. The final decision on any claim will be based on whether, in PressCo's sole opinion, a) a "normal reproduction" loss has been made, and b) the claimed defect affects the sale ability or usability of the merchandise. In any event, PressCo's responsibility shall be limited to correction or replacement of the product, or at PressCo's option a credit allowance in whole or part.

IMPORTANT ! Under absolutely no circumstances will postage be refunded or replaced for any reason once a job has been delivered to the Post Office.

Proofing

PressCo is responsible to print your job to match your final approved proof. If there is a variation, other than color variations, between your final approved proofs PressCo will replace the work at no cost to you.

Final proof approval is the responsibility of the purchaser. No job is sent to press without a Proof Approval or waiver of proof approval being received or waived by the purchaser. Proofs are very important and should be taken very seriously. It is not uncommon for file modifications to occur as your files are processed for printing. Just because everything was correct on your submitted file does not mean a change has not occurred while processing your file for printing. It is for just that reason that we supply a proof of your file after it has been processed. Words or numbers can be changed or dropped, text may wrap differently, and images can default to black & white, be cropped or cut off, hidden or dropped altogether. Any number of unintended changes can and will happen. Sometimes minor repairs necessary to output your files may require re-keying and numbers can be inadvertently changed, words misspelled, punctuation changed, or any of those items may be dropped or otherwise hidden.

Your proof approval certifies that you have thoroughly and fully reviewed and approved for printing your proof as supplied by PressCo. PressCo will not be responsible for any copy or design errors including but not limited to; incorrect dates, numbers, misspelled words, hidden or otherwise distorted images, text re-wrapping etc. that appears in your final approved proof.

Color Matching

PressCo offers products printed to "pleasing color" standards using standard ink densities.
Because of differences in equipment, paper, inks, and other conditions between color proofing and production press room operations a variation in color between digital color proofs is to be expected and will be considered acceptable performance.

PressCo will use its best efforts to produce a high quality reproduction of the original or proof, but does not warrant an "exact color" match under any circumstances. Nor will we guarantee that we can match colors to any of the following:

Colors as seen on your computer monitor.
Colors as seen on laser, ink jet and other types of digital proofs.
Colors as seen on previously printed orders.
Colors from original photographs, slides or other source

Liability 

Disclaimer of Express and Implied Warranties: PressCo warrants only that the work will conform to the description contained on the order form. Proofs, samples, copy, dummies, and preparatory work shown to or supplied by customer are intended to illustrate the general type and quality of work. They are not intended to represent the actual work performed. PressCo's maximum liability, whether by negligence, contracts, or otherwise, will not exceed the return of the amount invoiced for the work in dispute. Under no circumstances will PressCo be liable for specific, individual or consequential damages. PressCo will use its best endeavors to deliver at the time stated and all delivery dates shall be regarded at best as estimates only. The purchaser must accept the actual delivery date and the PressCo shall not be liable for any losses, costs, damages or expenses suffered by the purchaser or any other party as a result of any delay in delivery.

Preparatory Work

Art work, sketches, copy, dummies, type, separations, negatives, positives, plates, digital files, creative work, and all preparatory work furnished by PressCo shall remain PressCo's exclusive property, and no use of same shall be made nor may any ideas obtained there from be used, except by written permission of PressCo and upon compensation (if any) to be determined by PressCo.

Over Runs & Under Runs
PressCo will exert its best effort to ship the exact quantity ordered. PressCo does not automatically charge for overruns but will make them available for purchase at a pro-rata cost, if the Purchaser wishes. Under runs are allowable by industry standards at up to 10% of the quantity ordered, the Purchaser will be billed only for the quantity shipped within this tolerance. If an exact quantity is required order accordingly.

Production Schedules

PressCo expresses production times in terms of normal workdays from receipt of final proof approval to shipment. Weekends, holidays, and transit times are not included.

Production schedules are subject to the normal variations customary in the industry, and delays due to fire, strikes, equipment breakdown, inability to obtain materials, and any other circumstances beyond PressCo's control. Such delays shall not serve to invalidate any order or subject PressCo to damages. Where the date of shipment is specified on the order and for any reason it is not possible to ship on or before the date specified, PressCo will use its best efforts to ship as soon as possible thereafter and Purchaser agrees to accept the merchandise when so shipped.

Communications

To avoid any misunderstanding, and to ensure that all customer work is processed in an orderly manner all instructions should be in writing. Instructions not provided in writing may lead to problems for which we cannot be responsible.

Original Materials

PressCo shall take reasonable care of artwork, digital files, original copy, and other original materials left in PressCo's possession, but PressCo shall not be responsible for it as to loss or damage while in PressCo's custody. In recognition of the foregoing and as a material inducement to PressCo to enter into this agreement, Purchaser represents to PressCo that Purchaser has a duplicate of any and all original materials supplied in their possession.

PressCo is not responsible for the content or business practices of any third party web site that may be accessed through any links or hypertext on PressCo's site.

Shipping Terms

Prices are FOB PressCo's dock shipping charges to be paid by customer. Purchaser's recourse for loss or damage in transit is solely against the carrier. PressCo will gladly assist the Purchaser who wishes to replace any damaged or lost product by filing any such claim for them with the carrier provided the purchaser has indicated damages on the carrier's documentation when the goods are signed for. If the damages were not indicated upon receipt the purchaser must promptly notify and have the carrier inspect the damages.

PressCo will replace the damaged contents and charge you for the replacement. A refund will then be issued, not to exceed the amount of the claim payment by the carrier, when and if the carrier honors the claim and makes payment. Optionally you may choose to wait until the claim is paid before replacing the damaged product.

We make every effort to make sure that that we ship you some small amount in excess of the quantity ordered.

When ordering a job that is quantity critical please remember that due the nature press room operations and spoilage rates vary so industry standards dictate that Under runs are allowable by industry standards at up to 10% of the quantity ordered, the Purchaser will be billed only for the quantity shipped within this tolerance.

To keep our prices as low as possible our cost factors for spoilage are kept to a minimum. It is possible, although rare, that we could ship an order under run within the allowable tolerances. You will be billed for the actual quantity shipped and the order is considered shipped complete.

If you require an exact quantity please request a Custom Quote and we can make adjustments to be sure we do not ship less than you need.

The counts in all packages are electronically verified and the package weights recorded prior to shipping.

True shortage claims, receiving less product than you paid for, are extremely rare and almost always come from shipments that are further processed by a Mail House or other processing facility where spoilage occurs. Where exact counts are critical please allow for waste factors for the additional third party processing by ordering enough of an item to cover any anticipated spoilage.

Claims for shortages cannot be honored unless we can substantiate that our electronically verified counts are incorrect.

Storage

Storage charges on material held more than 30 days after job completion will be billed at current rate per skid or square foot of space used on a monthly basis. If the storage fees are not paid and the materials are not picked up for 90 days they will be discarded the purchaser or remains responsible for payment in full for the discarded material.

File Archiving

PressCo may, but is not obligated to, keep copies of purchaser's digital files for some period of time as a convenience to facilitate reorders. PressCo makes no implied guarantee that purchaser’s files will be available at any time.

This does not remove the purchaser's agreement and representation that they maintain and have duplicates of any and all original materials, including supplied files in their possession.
You may request a copy of your archived files if we have your files we will gladly supply them to you. We do not charge fees for archiving files however there are fees associated with un-archiving files and providing them to you.
Our archiving process stores multiple files compressed a CDs. To un-archive a file we first locate you file, copy the CD to a hard disk, uncompress the CD files, copy your file, re-compress and upload your file to our server and contact you with a link to download the file. The people that provide this service are the same prepress production people that process your file for printing. Obviously this takes some time usually anywhere from 30 minutes to an hour and we therefore must charge for the service.

Un-archiving fees are as follows:

Standard Turn 2-3 days $25.00
Next Day $50.00
Same Day $100.00

If you need a copy of your file on a CD there is an additional $35.00 CD burning charge per CD required plus any shipping charges.

If you need us to make changes, extract elements from your file such as logos, images etc. and /or make file conversions to your file or parts of your file there are additional prepress time charges at $75.00 per hour with a $25.00 minimum.
We do not bill for this service so please be prepared with your credit card information when you place your request. If after we conduct a search for you file we we determine that we do not have a copy of your file we will not charge your credit card the unarchiving fees. If we have your file the unarchiving fees are final and not refundable for any reason.
